Petitioner(s) Mr. Soumya Nag Ms. Namrata Chatterjee ... for the Petitioner(s) Mr. Bitashok Banerjee Mr. Sarthak Mondal ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is the driver of the vehicle who has been implicated on the accusations of having recovery of 42 kg of ganja. Learned advocate also submits that the petitioner is in custody for eight months and charge has been framed but witness action is yet to commence.

Learned advocate for the State opposes the prayer for bail and submits that sufficient materials are available. Be that as it may, having considered that commercial quantity of contraband has been seized, I am of the view that Section 37 of the NDPS Act is attracted. Hence, the prayer for bail of the petitioner is Rejected.

However, State is directed to complete the evidence of the seizure list witnesses within a period of sixty days from the next date so fixed.

The petitioner would be at liberty to renew his prayer for bail after the aforesaid period is over.

Accordingly, CRM(NDPS) 1298 of 2025 is dismissed. Pending application(s), if any, is also disposed of. This order be communicated to the learned trial court through the learned advocate appearing for the State.
