Dismissed that the petitioner is in custody for 8 months 7 days, charge-sheet has already been submitted and learned advocate submits that there is hardly any scope of the trial progressing as charges have not been framed till date. Learned advocate prays for bail on any stringent conditions.
Learned advocate for the State submits that on 14th January, 2026 date has been fixed for consideration of charges. I have taken into account the statement under Section 183 of the BNSS and as well as the fact that the lady refused to
undergo medical examination. There is some scope of interpretation so far as the statement under Section 183 of the BNSS is concerned. Considering the same, at this stage, I am not inclined to release the petitioner on bail.
As such, the prayer for bail of the petitioner in CRM(M)1989 of 2025 is dismissed.
Learned special court is directed to complete the evidence of the victim girl within one month from the date of consideration of charges.
Petitioner would be at liberty to approach this Court for renewing his prayer for bail after the evidence of the victim girl is over.
