The petitioner alleges illegal and unauthorized construction at the behest of the private respondents. The private respondents deny the allegation of the petitioner. It has been submitted that the construction was over in the year 2018. Revised sanctioned plan was issued by the Corporation in the month of January 2019.
Learned advocate appearing for the Corporation submits, upon instructions, that the unauthorized construction has been permitted to be retained upon acceptance of fees.
It appears from the submissions made on behalf of the parties that the construction which was alleged to be unauthorized has been permitted to be retained by the Corporation.
Accordingly, the allegation of the petitioner regarding unauthorized construction cannot be accepted.
If the petitioner is aggrieved by the order of retention passed by the Corporation, then it will be open for the petitioner to take appropriate steps in accordance with law, if permissible.
The writ petition stands disposed of.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
