Kausik (Rejected) CRM (NDPS) 1303 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nodakhali Police Station Case No. 495 of 2024 dated 21.12.2024 under sections 21(b)(ii)(c)/29 of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that initially a case was registered wherein one Sk. Nur Ilahi @ laden was arrested and from him 23.210 Kgs. of Ganja were recovered. Subsequently, present petitioner was arrested in connection with Nodakhali PS Case No. 41 of 2025. The Police Authorities prayed for jail interrogation of Sk. Nur Ilahi @ laden. Similar prayer was advanced in respect of the present petitioner which was kept in abeyance. On 10.02.2025 the prayer for showing arrest of the petitioner was allowed and on 13.02.2025 the jail interrogation of the petitioner was allowed. Subsequently, on 01.03.2025

25.26 Kgs. of Ganja were recovered from an abandoned house. Subsequently, a case was framed by the Investigating Officer alleging recovery from the joint possession of the petitioner along with one Sobraj Kazi @ Raja.

Learned advocate for the petitioner submits there is no possibility of the trial concluding in near future, as such the petitioner may be released on bail on any stringent condition. On the other hand, learned advocate for the State opposes the prayer for bail and submits that on specific information, the subsequent recovery was made. Charges have already been framed in the present case and the trial of the case is in progress.

Learned Trial Court is directed to give priority for examination of CSW 13 and 14, namely, Chandan Mondal and Souvik Das.

Let the examination of these two seizure list witnesses be completed within a period of 60 days from the next date so fixed before the learned Trial Court.

Petitioner will approach this Court after the examination of evidence of these two seizure list witnesses are over. At this stage, the prayer for bail of the petitioner in CRM (NDPS) 1303 of 2025 is dismissed.
