Abu Jafar ... for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants and is directed against an order being no.63 dated 25th April, 2024 passed by the learned Civil Judge (Senior Division), 2nd Court Krishnagar, Nadia in Title Suit No. 37 of 2016. By the order impugned the application for amendment of the written statement stood rejected. It is not in dispute that the application for amendment was filed after the commencement of trial. In the application for amendment the plaintiff has not explained the reasons for filing such application at such a belated stage. The learned trial judge assigned cogent reasons for rejection of the said application. This Court does not find any reason to interfere with the order impugned.

Accordingly, C.O. 3537 of 2024 stands dismissed. There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
