Mr. Abhijit Sarkar, Mr. Raja Biswas, Ms. Tanima Nandy ...for the petitioner Mr. Ramchandra Guchhait ...for the State Mr. Debasish Kundu ...for the respondent nos. 4 to 8 The petitioner seeks appropriate reliefs to conduct a local enquiry in the scheduled land and fix the proper valuation in respect of the subject premises.

Briefly, the subject premises is an undivided property. The petitioner happens to be one of the co-sharers and alleges to have a peremptory right in respect of the property. The petitioner also alleges that some of the co-sharers have sold their undivided shares of the premises and the petitioner seeks valuation of the subject premises.

On behalf of the respondent State Authorities it is submitted that the petitioner has been unable to demonstrate any legal enforceable right which

warrants any of the reliefs to be granted in the writ petition.

In view of the facts and circumstances as alleged in the petition, the petitioner has been unable to demonstrate any right for a local enquiry being held and for ascertainment of the proper valuation of the subject premises.

In view of the above, W.P.A. No. 24176 of 2022 stands dismissed.

There shall be no order as to costs.

Urgent photostate certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
