Mr. Kar, learned advocate appearing for the petitioner submits that earlier there was a direction by the High Court regarding the payment which has been made. The execution case till date is continuing irrespective of that not a farthing has been paid. Last of the order-sheet reflects that the learned Judicial Magistrate 3rd Court, Chinsurah, Hooghly is awaiting the execution return of the distress warrant.

Learned Judicial Magistrate, 3rd Court, Chinsurah, Hooghly is directed to expedite the process of exhausting the harsher process of law. In case the learned Judicial Magistrate, 3rd Court, Chinsurah, Hooghly is of the opinion that the opposite party/husband is purposely violating and/or evading the process of law to flee away from the course of justice, learned Judicial Magistrate, 3rd Court, Chinsurah, Hooghly would communicate with the Deputy Commissioner of Barrackpore Police Commissionerate who is in-Charge of Khardah Police Station. The concerned Deputy Commissioner of Police would communicate with the competent

authority of police in-charge of Barakhamba Road, New Delhi- 110 001.

The warrant of arrest or any other process issued by the learned Judicial Magistrate, 3rd Court, Chinsurah, Hooghly would be executed and the report be sent both to the Deputy Commissioner, Barrackpore Police Commissionerate, preferably (Deputy Commissioner of Police in-charge of Khardah Police Station) as also the learned Judicial Magistrate, 3rd Court, Chinsurah, Hooghly.

With the aforesaid observations, CRR 3924 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.
