Affidavit of service filed by the petitioner is taken on record.
No one is present for the State respondent in spite of service of notice. Hence, the matter is taken up for adjudication, in absence of the said respondent. The petitioner is aggrieved that neither his fate as a wait-listed candidate in SLST (HM), 2017 has been informed to him by the respondent/West Bengal Central School Service Commission, nor his application under the Right to Information Act dated September 23, 2019 has been answered by the said respondent, as yet. The fact remains that the petitioner having participated and being successful in the 1st SLST(HM), 2017 Examination, has found place as the wait-listed candidate in the panel prepared in the said selection process. Since thereafter the petitioner has found his fate to be uncertain.
His application dated September 23, 2019 under the Right to Information Act, receives no attention of the Authorities even after lapse of statutory period of limitation.
The Court finds it proper to dispose of the present writ petition by directing the respondent no. 3/
Chairman, West Bengal Central School Service Commission to immediately reply within a period of two weeks from the date to the application filed by the writ petitioner under the Right to Information Act, that is application dated September 23, 2019.
It is mentioned further that in the case, the respondent no. 3 finds the grievance of the petitioner to be genuine, necessary follow up steps in accordance with law shall immediately be taken by the said respondent. The entire exercise as above shall be completed within a period of four weeks from the date of communication of copy of this order.
With the above observations and directions the writ petition being WPA 22218 of 2019 is disposed of. Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
