The Block Development Officer of Barabazar Block shall treat the writ petition as a representation and dispose of the same in accordance with law. While doing so, a representative of the petitioners and the pradhan of Latpada Gram Panchayat shall be heard.

The Block Development Officer is of the opinion that the petitioners did not exercise their option correctly while applying for the grant of benefit under the Pradhan Mantri Awas Yojana. As a result, their applications had become defective and could not be processed. It is further submitted that the final list had been prepared and the scheme had come to an end. It is also submitted that as and when a further scheme on similar lines is advertised, the petitioners may apply afresh in accordance with law.

Be that as it may, as the petitioners have approached the authority, a reasoned order shall be

passed and communicated to the petitioners. The reason for non-conclusion of the petitioners in the list of beneficiaries shall be disclosed.

The court has not gone into the merits of the claims and counter claims of the parties.

The entire exercise shall be completed within a period of four months from the date of communication of this order.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
