In the instant revision the petitioners/accused persons have prayed for expeditious disposal of the case. It is submitted by the learned advocate for the petitioner that the petitioners were booked in connection with Mogra Police Station Case No.84
of 2006 dated 9th July, 2006 under Sections 399/402 of the Indian Penal Code and Section 25(1B)(a)/27/35 of the Arms Act on 9th July, 2006. Police submitted charge sheet in due course. However, during the last 16 years the learned Chief Judicial Magistrate at Hooghly could not pass the order of commitment though out of six accused persons five accused persons are on bail and they are regularly appearing before the learned Chief Judicial Magistrate, Hooghly and in respect of another accused namely Sanjib Mistri the police authority has already issued proclamation order and sent the report to the Court of the learned Chief Judicial Magistrate, Hooghly on 29th October, 2022 Therefore, there cannot be any predicament in committing the case to the Court of Sessions. The learned Chief Judicial Magistrate, Hooghly at Chinsurah is directed to commit the case record within three weeks from the date of communication of this order.
The instant revision is accordingly disposed of. The petitioner is at liberty to act on the server copy of this order.
