Petitioner approached this Court with the prayers for directing the State-respondents to ensure peaceful possession of the schedule suit property and for removal of the puja pandel and other structures set up by the private respondents.

Learned advocate appearing for the State submits that the petitioner in fact has made prayers for execution of a decree by preferring an application under Article 226 of the Constitution of India. Having considered that the Civil Procedure Code contains enough provisions for breach of any order, the petitioner be well advised to approach the jurisdictional civil court with prayers for necessary relief. So far as the writ petition is concerned, I direct the police authorities to ensure that there should not be any violation of law and order and in case situation so arises to take steps in accordance with law.

With the aforesaid observations, WPA 24678 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
