Versus

The State of West Bengal Mr. Debasis Kar Ms. Suhana Parvin Ms. Paramita Mitra Mukhopadhyay.

...for the petitioner.

Mr. Md. Adil Badr Mr. Sarthak Mondal.

...for the State.

Petitioner is the husband of the deceased/victim who was Bpg.

Allowed arrested in connection with the instant case. Learned advocate submits that the marriage between the petitioner and the wife/deceased/victim was solemnized on or about February, 2021. There is a minor daughter aged about three years. Learned advocate appearing for the petitioner has drawn the attention of the Court to the letter of complaint and submitted that there are allegations against all the members of the matrimonial home and the wife/deceased/victim committed suicide by way of hanging. Learned advocate appearing for the State opposes the prayer for bail and submits that the investigation of the case is still in progress and the other accused persons are not cooperating with the investigation.

Be that as it may, I find from the statement under

Section 164 of the Cr.P.C. which has been recorded that the primary allegations are against the present petitioner. Having considered the period of detention of the present petitioner, I am of the view that further custodial detention of the petitioner is not required.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner namely, Rajib Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Barrackpore, North 24-Parganas. If on bail, the petitioner shall meet with the investigating officer of the case once in a week till the charge-sheet is submitted before the jurisdictional court. Accordingly, CRM (M) 2059 of 2025 is allowed. Case diary be returned to the learned advocate appearing for the State.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
