Noor Hossain @ Joralka v. The State Of West Bengal
D/L 154 26.11.2025 Bpg.
Dismissed C.R.M. (M) 2081 of 2025 In Re: An application for Bail under Section 439 of the Code of Criminal Procedure, 1973/correspondence under Section 483 BNSS, 2023 filed in connection with Khardah Police Station Case No.68 of 2024 dated 31.01.2024 under Sections 363/302/201 of the Indian Penal Code; Noor Hossain @ Joralka
Versus
The State of West Bengal Mr. Debasis Kar Ms. Paramita Mitra Ms. Suhana Parvin.
...for the petitioner.
Mr. Prasun Kumar Dutta Mr. Sobham Gani.
...for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 9 months and there are 26 witnesses who have been relied upon by the prosecution but none of the witnesses have been examined till date. Learned advocate appearing for the State opposes the prayer for bail and submits that the offence was committed in heinous manner.
I have considered the case diary and I am of the view that, at this stage, it would not be fit and proper to release the petitioner on bail.
Accordingly, CRM(M) 2081 of 2025 is dismissed at this stage.
