Mr. Ratul Biswas, Mr. Kaushik Chowdhury ... for the WBBPE. The petitioner is an Assistant Teacher at Kastosangra Lalit Mohan Primary School, a school under Amta East Circle of Howrah District Primary School Council.

The petitioner is praying transfer to any school of her choice at her home district Murshidabad on the grounds that her present school is 311 kilometers away from her residence and she has a child of 5 years. The petitioner is also alleging that she is a surplus teacher of her present school.

The distance itself is no ground for transfer unless it is coupled with some other factors. The petitioner is receiving house rent allowance for the purpose of her stay at her place of posting.

The petitioner, if a surplus teacher, the Howrah District Primary School Council shall take appropriate steps for her transfer to any school where there is shortage of teacher.

The prayer of the petitioner for transfer therefore is refused.

W.P.A. 24720 of 2024 is dismissed without any order as to costs.
