1. Heard the submissions of both the learned Advocate.
2. It is submitted by the learned Advocate for the petitioner that the petitioner is innocent, falsely implicated and more so all other coaccused persons are enlarged on bail and he is same footing that of all the co-accused. It is also submitted that in course of this day also another co-accused has been enlarged on bail, which has been endorsed by the learned Prosecution.
3. In view of the facts and circumstances and considering the prayer of the petitioner, the instant application for bail stands allowed on the ground of parity.
4. Accordingly, the petitioner, namely, Bakibilla Gazi, be released on bail upon furnishing a bond of Rs. 20,000/- (Rupees twenty thousand), with two registered sureties of Rs. 10,000/- (Rupees ten thousand) each, to the satisfaction of the learned Chief Judicial
Magistrate, Barasat, with the condition that the present accused petitioner shall appear before the learned Trial Court on each and every date of substantive hearing unless his personal appearance is dispensed with by the learned Trial Court.
5. It is further ordered that in the event of his absence even for a single day before the learned Trial Court, the learned Trial Court is at liberty to issue non-bailable warrant of arrest for the apprehension of the present accused petitioner.
6. Let the case diary be returned.
