The petitioner claims to have purchased the property from the private respondent no. 6.

After purchase and occupation, the private respondent was allowed to stay in the property for medical treatment of her daughter. The private respondent has not left the property thereafter.

This Court is of the view that the dispute between the petitioner and the private respondent is civil in nature and appropriate civil proceeding shall be taken out.

The petitioner has also taken out proceedings under the Senior Citizen Act, 2007.

The SDO, Burdwan Sadar (North), Purba Bardhaman, shall dispose of the said application of the petitioner under the Senior Citizen Act, 2007, mandatorily and positively

within a period of one month from date, if not already disposed of.

The Burdwan Sadar Police Station shall ensure that there no breach of peace in the area.

With the aforesaid observation, the instant writ petition shall stand disposed of.

7.

There shall be no order as to costs.

8.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
