CRR No. 4277 of 2024 In Re: Smt. Kamala Halder Mr. Partha Chakraborty ... For the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of Criminal Misc. Case no. 5424 of 2023 under Section 439(2) of the Code of Criminal Procedure pending before the learned District and Sessions Judge, Alipore, South 24 Parganas, the matter may be considered without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.

It appears that the petitioner filed a petition for cancellation of bail under Section 439(2) of the Code of Criminal Procedure before the learned District and Sessions Judge on 22nd December, 2023. Learned Sessions Judge has fixed several dates for hearing of the application despite presence of both the parties and production of the case diary by the investigating officer.

Since the application is pending for quite sometime, learned Sessions Judge, Alipore, South 24 Parganas is directed to consider and dispose of the application on the next date of hearing fixed before him and if the same is not possible due to unavoidable circumstances, within one month thereof.

The revisional application is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
