This is an application under the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India alleging violation of order dated 26.07.2023 passed by this Court in WPA 16855 of 2023.

Learned counsel appearing on behalf of the petitioner submits as follows. By an order dated 26.07.2023 passed by this Court, it was recorded that as regards the allegations of illegal activities by the private respondents, an FIR has been

lodged and as such, there was no need for further direction. However, the police was directed to keep a sharp vigil so that no breach of peace took place and that no order of a Civil Court was violated. There is a clear violation of this order. The police did not keep a vigil as directed. This led to certain disturbances. Despite making complaints, no steps were taken.

It appears from the original order that as an FIR had been registered over the allegations made by the petitioner, no further direction was passed by this Court except for a direction upon the police to keep a vigil and see that no breach of peace took place or no order of a Civil Court was violated. However, no specific instance has been cited by the petitioner about violation of this portion of the order.

Therefore, no further order need be passed in this order. It is expected that the respondent authorities shall abide by the order passed by this Court earlier.

However, if there is a fresh cause of action, the petitioner shall be at liberty to take appropriate steps.

With these observations, the contempt application being CPAN 1615 of 2024 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
