The petitioner prays for leave to make an appropriate application before the banking ombudsman being the respondent no. 3.

Learned counsel appearing for the respondent no. 1 submits that WPA 17088 of 2021 is pending and the same has to be withdrawn.

The petitioners herein give an undertaking that the same shall be withdrawn at the earliest.

The petitioners submit that they shall withdraw WPA 17088 of 2021 the same within two days of the reopening after vacation but prays leave to file the representation prior to that.

Leave as prayed for is granted on the condition that though the petitioner will be at liberty to file the representation prior to withdrawal of the writ application, the respondent no. 3 shall take up the

representation for consideration, thereafter on being satisfied that the writ application has been withdrawn and the said representation before the ombudsman be disposed of within 45 days thereafter on giving an opportunity to all the parties and by passing a reasoned order in accordance with law.
