The petitioners seek an early disposal of the application of the petitioners under Section 14 of the SARFAESI Act, 2002 which is pending beyond the statutory stipulated period.

It is submitted by learned counsel for the petitioners on query of court that no application under Section 17 of the SARFAESI Act, 2002 is pending to hinder the progress of the Section 14 application.

The affidavit-of-service filed today be kept on record.

None appears for the respondents at the time of call.

In view of the above, WPA No. 23861 of 2023 is disposed of by directing the respondent no.2, that is, the District Magistrate, Purba Bardhaman to dispose of the petitioners' application under

Section 14 of the SARFAESI Act, 2002 as expeditiously as possible, positively within three weeks from the date of communication of this order to the said respondent.

The parties shall act on a server copy of this order without insisting upon prior production of a certified copy thereof for the purpose of compliance.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
