Mr. Nirmalendu Bera Mr. Gora Chand Samanta ...for the petitioners Mr. Krishna Das Poddar ...for the State The grievance of the petitioners is directed against non-consideration of a representation dated July 5, 2024 addressed to the Pradhan of the Sarangabad Gram Panchayat being the respondent no.5 herein. It is submitted on behalf of the petitioners that the private respondents unauthorisedly and illegally carried out a construction at the subject premises without obtaining any lawful permission or sanction.

The State is represented and relies on a police report dated November 28, 2024 to suggest that the appropriate permission has been granted in respect of the ancestral property of the private respondents and that there is nor illegal or unauthorized construction at the subject premises.

In view of the submissions made on behalf of the parties, WPA No.24835 of 2024 stands disposed of by directing the respondent no.5 to consider and dispose of the petitioners' representation dated July 5, 2024 within a period of six weeks from the date of communication of this order and in accordance with law after giving a right

of hearing to all the parties.

It is made clear that there has been no adjudication on the merits of the case and the respondent no.5 is to act strictly in accordance with law without being influenced by any observations made hereinabove and after hearing all the parties. All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
