2. The fiat of the application shows that the Department has not received any notice of caveat.

3. This is an application under Article 227 of the Constitution of India.

4. The solitary grievance of the petitioner is that the application filed by the petitioner at Page-38 to the petition is pending for a considerable period of time before the Court of the learned Civil Judge, (Senior Division), Balurghat, Dakshin Dinajpur.

5. In view of the above, the said concerned Civil Judge shall take up the said application annexed at Page-38 to the petition and dispose it of by passing a reasoned order in accordance with law within a period of three months from the date of communication of this order.

6. It is made clear that this Court has not gone into the merits of the said application or the merits of the claim of the petitioner.

7. With the above observations and directions, this application being CO 3758 of 2025 stands disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
