The petitioner prays for interest on delayed payment on the retiral benefits.

It is now well-settled that the retiral benefits are required to be paid immediately as the employee has no source of income after employment.

The petitioner superannuated on 29th February, 2016. Retiral benefits were paid on three tranches. On 17th June, 2016 Rs.4,00,000/- was paid, on 1st August, 2016 Rs.36,109/- was paid and on 2nd August, 2016 Rs.18,82,519.09/- was paid.

The petitioner is, therefore, entitled to interest at the rate of 7% per annum for the period of 3 months 17 days on the total sum of Rs.23,18,628.09/- and for the period of 5 months 2 days on the total sum of Rs.19,54,737.09/-.

Let the interest be paid to the petitioner for the aforesaid period by 20th December, 2023. In default of

payment as indicated hereinabove, the rate of interest shall stand increased to 11% per annum.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
