Kolkata Police Station Case No. 01 of 2021 dated 03.01.2021 corresponding to NDPS Case no. 02 of 2021 under Sections 21(c)/22(c)/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for five years and till date the trial has not been concluded. It has been stated that 26 kgs of 'YABA Tablets' and 2 kg of 'Heroin' were recovered from the joint possession of the petitioners and others. Learned advocate for the State opposes the prayer for bail and submits that the examination of six witnesses is over and the evidence of the investigating officer is in progress who is the last witness on behalf of the State.

Having considered that the trial of the case is at the advance stage, I am not inclined to interfere. Accordingly, CRM (NDPS) 1317 of 2025 is dismissed.

Learned Special Court is directed to ensure that the evidence of this witness is concluded by 15th of January, 2026. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
