Court No. 36 WPA 24248 of 2022 (265715) Raju Roy Vs.
Union of India & Ors.
30.08.2024 (AD 31) (S. Banerjee) Ms. Reshmi Ghosh Ms. Parna Mukherjee ...for the petitioner Mr. Dhiraj Kumar Trivedi, DSGI Mr. Jasojeet Mukherjee ...for the Union of India Mr. Amajit De, Special PP, CBI ...for the CBI Learned counsel for the petitioner submits that at the juncture when the writ petition was filed, a challenge had been thrown to the summons issued by the respondents/Central Bureau of Investigation (CBI) dated May 11, 2022. Subsequently, the petitioner has furnished all relevant documents pursuant to such summons under Section 91 of the Code of Criminal Procedure and has also been interrogated by the CBI.
It is submitted that the petitioner may not be harassed further in connection with the investigation, except in accordance with law.
Learned counsel for the CBI submits that the petitioner has, in fact, complied with the impugned summons by furnishing the relevant documents. In
the event the CBI requires in future to summon the petitioner in connection with the investigation and/or otherwise have any dealings with the petitioner in such respect, the CBI will do so in accordance with law.
In fact, the present writ petition has become infructuous, as it appears from the facts narrated above.
In any event, it is expected that the CBI, being an investigating agency, shall comply with the law and act in accordance with law in conducting its investigation in the affair which is the subject-matter of the present petition.
With the above observations, WPA 24248 of 2022 is dismissed as infructuous.
