IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction 01-08-2022 Subha Item no.07 Ct no.34 CRR 4027 of 2009 Padam Mittal & Anr.

-versus- The State of West Bengal & Anr.

Mr. Sandipan Ganguly, Sr. Advocate Mr. Dipanjan Dutt Mr. Amitava Mitra Ms. Antara Choudhury ...for the petitioners.

Mr. Anwar Hossain Ms. Manisha Sharma ....for the State.

Pursuant to the order dated July 20, 2022, a report has been submitted by Mr. Hossain, learned advocate appearing on behalf of the State. Let the report be kept with the record. Such report has been prepared by the Inspector-in-Charge, Purulia(T) Police Station on 28.07.2022 incorporating a further statement of the de facto complainant as well as the earlier affidavit which was filed on 28th May, 2009. The de facto complainant has stated before the police authorities that there has been an amicable settlement and he do not intend to proceed with the case and subsequent proceedings arising out of Purulia (T) P. S. Case No. 44 of 2009 dated 0905-2009 and the chargesheet submitted in connection with the said case before the jurisdictional court.

The dispute and difference is private and personal in nature and there is no offence which would involve the public at large. Accordingly, I am of the opinion that the continuance of the proceedings arising out of Purulia (T) Case No. 44 of 2009(G. R. Case No. 369 of 2009) are unwarranted and as such the same is quashed.

Accordingly, the revisional application being CRR 4027 of 2009 is allowed. Pending applications, if any, are consequently disposed of. Interim order, if any, is made absolute.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
