Learned advocate for the State has referred to the medical document which is of 15th September, 2022. The petitioner is on bail for more than three years ten months. If there are change of circumstances thereby deterring the defacto-complainant and/or her family members to freely pursue the case before the learned trial court, then, in that case, an appropriate application be preferred before the learned trial court. The learned trial court would deal with the same in accordance with law.

In case, the learned trial court finds that there are genuinity in the accusations of the victim and/or her family members, in that case, necessary protection be extended under the Witness Protection Scheme.

At this stage, after lapse of prolonged period, this court is not inclined to interfere with the case.

There is no specific allegation of overact which is brought to the notice of the court. However, the same will not prevent the learned trial court from passing any directions which would be for the betterment of the trial of the case which is pending. With the aforesaid observations, CRM (DB) 3428 of 2024 is disposed of.
