Ct. No.17 application for participating in TET 2023 for primary teachers and they are all B. Ed. pass candidates. At least one of the petitioners has shown one certificate which is at page 298 (Annexure 'P-10') of the writ application. It appears that the certificate for passing his Diploma in Elementary Education-Open and Distance Learning was issued on 27.09.23. But the advertisement of the West Bengal Board of Primary Education clearly mentioned (Annexure 'P-7' at page 288 of the writ application) that candidates who will acquire minimum eligibility criteria beyond the date of publication of this notification will not be entertained for applying in TET-2023. From the said certificate in respect of one of the petitioners Ashis Sahoo (Petitioner No.21) it appears that certificate was issued on 27.09.2023 i.e. after publication of the advertisement of the West Bengal Board of Primary

Education on 13.09.23. Therefore, this candidate is also not eligible for participating in ensuing TET Examination.

I have considered the Judgement delivered by the Hon'ble Supreme Court reported in 2023 SCC OnLine SC 985 (Devesh Sharma Vs. Union of India & Ors.) and similar other matters wherein Hon'ble Supreme Court has negated B.Ed. degree for participation in the recruitment process for primary teachers.

Here in the present case only one of the petitioners has been able to show that he obtained one D. El. Ed. qualification. He has obtained it on 27.09.2023 and not before publication of the advertisement of the West Bengal Board of Primary Education i.e. on 13.09.23.

Therefore, this writ application is not entertained and the same is dismissed.
