Kausik (Allowed) CRM (M) 1325 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Lalgola Police Station Case No. 237 dated 20.03.2025 under Section 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 230 days and the investigation of the case has already been concluded. It has been pointed out that the present petitioner has been implicated on the basis of the statement of two coaccused persons who were arrested and from whose possession seizures of contraband were effected.

Learned advocate for the State opposes the prayer for bail and submits that the recovery so made is of commercial quantity and the petitioner being named by the co-accused should not be granted liberty at this stage as charge is yet to be framed by the learned Trial Court.

Having regard to the fact that there has been no recovery from the present petitioner and on perusal of the case

diary it reflects that the petitioner has been implicated in connection with the instant case on the basis of statement of two co-accused persons, I am of the view that further detention of the petitioner is unwarranted in connection with the instant case.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand) each. One of whom must be local to the satisfaction of the learned Special Judge, NDPS Act, Berhampore, Murshidabad.

If on bail the petitioner shall be physically present before the trial court and shall not leave the jurisdiction of District of Murshidabad without prior permission of the learned Special Court.

Accordingly, CRM (NDPS) 1325 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
