The petitioner is an approved Assistant Teacher of Domohani Kelejora Girls' High School (H.S.), District - Paschim Bardhaman of the subject Sanskrit (H/PG). The prayer of the petitioner for higher scale of pay on enhancement of her qualification in the relevant subject is long pending before the Additional District Inspector of Schools (S.E.), Arambagh, DistrictHooghly, the respondent no. 5 herein. The petitioner is praying immediate disposal of the said prayer.
Mr. Das, learned advocate for the petitioner submits that in view of different judgments of this court, the right of the petitioner to get such higher scale of pay stands crystallized.
The judgments of this Court on this subject since are needed to be considered to decide the entitlement of the petitioner to get the higher scale of pay as
prayed for, the petitioner is granted liberty to file a comprehensive representation before the respondent no. 5 and the said respondent, within eight weeks from the date of filing of such representation shall dispose it of, in accordance with law, if necessary, after giving the petitioner or her representative an opportunity of hearing.
The petitioner is obliged to place all relevant judgments before the said respondent at the time of hearing of the said representation.
W.P.A. 23886 of 2023 is thus disposed of with the above terms without any order as to costs.
Since no affidavit has been invited, the allegations made in the writ petition are deemed to have denied by the respondents.
