In terms of the order dated 1st October, 2024 original succession certificate is produced before this Court which is dated 3rd March, 2020 issued by SubDivisional Civil Judge (Jr. Division), Ghatal Court, (District Delegate).

It has been rightly pointed out by the learned advocate representing the State respondents that such succession certificate dated 3rd March, 2020 has no applicability in the present case since petitioners have prayed for release of arrear pension from the date following the date of retirement of father of the petitioners till the date of refund made by their father who was an Assistant Teacher in a Government aided secondary school. Such succession certificate dated 3rd March, 2020 was issued for different purposes. Taking note of such submission made on

behalf of the State respondents, the writ petition stands disposed of granting leave to the petitioners to obtain appropriate succession certificate for receiving dues in connection with service of their deceased father.

If succession certificate is obtained and submitted before the concerned authority of the State respondents prayer of the petitioners for releasing the benefits shall be considered in accordance with law and in terms of the orders passed by this Court in similar other matters.

Original succession certificate dated 3rd March, 2020 is returned to the learned advocate representing the petitioners.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
