Learned counsel for the petitioner submits that other than a statement of a co-accused there is no material available against the present petitioner.

Learned counsel for the State opposes the prayer for anticipatory bail, points to the case diary, refers to the report and submits that there is a criminal antecedent of the present petitioner being Berhampore PS Case No.1639 of 2024 under Sections 20(b)(ii)(C)/25/28/29 of the NDPS Act. Considering the materials available in the case diary, the criminal antecedent of the petitioner and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
