Perused the case diary.
It appears that the house under construction from where the contraband was seized belonged to the petitioner's father. After his demise, the petitioner, and his brother and mother inherited the same. As per the statements of the brother and the mother of the petitioner as well as the neighbour, the petitioner is the one who was in possession of the building.
Considering the incriminating materials available in the case diary including the seizure list and the statements of witnesses and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner.
The application for anticipatory bail being C.R.M. (A) 3538 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
