Versus
Sri Bidhut Mukherjee In Re: An application under 401 read with Section 482 of the Code of Criminal Procedure, 1973.
The revisional application was preferred against the order dated 27.12.2011, 06.03.2012, 23.05.2012 and 02.08.2012 passed by the Learned Judicial Magistrate, 2nd Court, Alipore in ACM No. 512/2009 under Section 125 of the Code of Criminal Procedure. The records reflect that by an order dated 05.08.2011, the Learned Magistrate was pleased to allow a sum of Rs. 1,000/- per month to the wife and Rs. 1,000/- to the minor child aggregating to a sum of Rs. 2,000/- per month. The said amount was paid by way of an interim maintenance during the pendency of the main application under Section 125 of the Code of Criminal Procedure.
Having regard to the quantum, which was awarded by way of interim maintenance and the fact that more than 9 years time has elapsed in the meantime, I am of the view that no interference is called for.
Accordingly, CRR 3261 of 2012 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
