At the time of hearing learned Advocate appearing on behalf of the writ petitioners submits before this Court that after filing of the instant writ petitioner it has been noticed that the remedy lies with the writ petitioners before the West Bengal Land Reforms and Tenancy Tribunal.

In view of such, WPA 24839 of 2024 is dismissed as not maintainable.

However, before parting with it is made clear that since the writ petitioners are pursuing their remedy in a wrong forum this Court directs that in the event the writ petitioners file an application before the aforementioned Tribunal within 30 working days from today on the selfsame cause of action the said Tribunal shall not consider the delay, if there be any, in filing such application. 4.

It is further made clear that since affidavits have not been called for the allegations as made in the instant writ petition are deemed to have been denied.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
