Swagata Panda Mr. Souma Subhra Ray Mr. Arpan Sinha Ms. Susmita Mondal ... ... for the petitioner Petitioner submits that he has been directed to grant interim maintenance aggregating to sum of Rs.16,000/- (Rupees sixteen thousand only) in respect of his wife and two daughters. I find from the records that the foundation of such order was on the basis of a sum of Rs.48,000/- (rupees forty eight thousand only) received as salary.

Learned advocate appearing for the petitioner submits that there is substantial house loan which is to be liquidated and his old ailing parents who require regular financial assistance for medical treatments.

I find some force in the submissions advanced by the learned advocate appearing for the petitioner. Learned advocate for the petitioner is granted liberty to take out an application under section 127 of the Code of Criminal Procedure wherein he would point out regarding the three issues firstly, the amount he has received as salary; secondly, all documents to be produced regarding the housing loan which by way of EMI is withdrawn; thirdly, regarding the medical documents and the expenses of the parents. Learned trial Court would consider such an application in accordance with law within a period of six weeks from the date of filing of such application.

With the aforesaid observations, CRR 4073 of 2022 is disposed of.
