Learned advocate appearing for the petitioner submits that the subject-matter of the case relates to recovery of 43 kgs. of ganja from a vehicle and the petitioner along with others were boarders in the said vehicle. Petitioner is in custody since 26.02.2025. As such, petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that since commercial quantity of contraband was seized, there is no scope for the petitioner to be released on bail. So far as the issue relating to medical grounds is concerned, the same was earlier considered on 31.07.2025 by a co-ordinate Bench of this Hon'ble Court in CRM(NDPS)

717 of 2025 and there are no fresh documents to substantiate regarding the present health condition of the petitioner.

However, so far as the prayer for bail of the present petitioner is concerned, the same is rejected. The Superintendent of Baruipur Central Correctional Home would take steps regarding the health of the petitioner and in case any medical attention is called for, proper steps be taken by the Superintendent of the concerned jail. The application for bail, being CRM (NDPS) 1336 of 2025, is, thus, disposed of.
