Noor Thandar ....for the petitioner Mr. Saibal Bapuli Mr. Arani Bhattacharyya ....for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. The petitioner was not there at the place of occurrence at the relevant time. In fact, he was not even named in the FIR. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the FIR maker is the wife of the victim who was not an eye-witness. During investigation, eye-witnesses clearly stated that the petitioner was one of the active participants in assaulting the victim, which led to his death. Post mortem report contains as many as eight injuries. Considering the incriminating materials available in the case diary including the post mortem report and the statement of eyewitness recorded before a Magistrate naming the petitioner, among

others, as an assailant, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
