The main grievance of the petitioner is that inspite of a Memorandum of Understanding entered into between him and the private respondents for nearly 20 years, he was subsequently restrained from interfering with the Nursing Home.

Learned advocate for the private respondents disputes and denies such contention and submits that they have

informed the police authorities, pursuant to which a criminal case has been registered.

State has submitted a report which reflects that on receipt of the complaint of the petitioner, Bishnupur PS Case No. 242 of 2024 was registered for investigation. The report further speaks that on the basis of the complaint of Mahur Ali Mallick (respondent) another case being Bishnupur PS Case No. 225 of 2024 dated 10.09.2024 was also registered for investigation. The investigation of both the cases at the relevant period when the writ petition was preferred was continuing.

In view of the police authorities having taken steps, I am of the view that no interference by this Court is called for.

However, as substantial time has passed since the registration of the FIR, if the petitioner is aggrieved regarding the progress of the investigation and/or

outcome of the investigation, he would approach the jurisdictional Magistrate for necessary relief(s).

So far as the other issue arising out of the agreement is concerned, the petitioner will approach the appropriate civil court for necessary relief(s).

With the aforesaid observations, WPA 24886 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record.
