Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1096 days and only the examination of the third witness is in progress out of 14 witnesses proposed to be examined by the prosecution. Learned advocate, therefore, submits that on any stringent conditions the petitioner may be released on bail.
Learned advocate for the State opposes the prayer for bail and produces the case diary particularly the statement of the witnesses before the learned Judicial Magistrate. Having considered the manner in which the offence has been committed, at this stage when the evidence is in progress, I am not inclined to release the petitioner on bail, but the learned trial court would ensure that 10 more witnesses are examined within the
next six months. Petitioner would be at liberty to renew his prayer for bail after 15th May, 2026.
For the present, CRM(M) 2077 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
