IN THE HIGH COURT AT CALCUTTA

Item No. M/L.136 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.

Rejected C.R.M. (M) 2102 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Hemnagar Coastal FIR No. 01 of 2025 dated 01.06.2025 under Section 14A(b) of the Foreigners Act and Section 12 of P.P. Act.

And In Re : Abdul Kalam Gazi ... Petitioner.

Mr. Debasis Kar, Ms. Suhana Parvin ... For the Petitioner.

Ms. Zareen N. Khan, Ms. Srilekha Chattopadhyay ... For the State.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for eight months. The charges against the petitioner are under the relevant provisions of the Foreigners Act. According to the learned advocate for the petitioner, charges have been framed, but trial of the case has not progressed.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

I find that six witnesses have been relied upon by the prosecution. Having considered the same, learned Trial Court is directed to take steps so that trial of the case is concluded at the earliest.

Having regard to the fact that petitioner has been implicated in a case under the Foreigners Act and is a resident of Khulna, Bangladesh, I am not inclined to release

the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Report submitted by the learned advocate appearing for the State be kept with the record.

The application for bail, being CRM (M) 2102 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
