Ld. advocate for the petitioner submits that initially the petitioner challenged the order of rejection of the anticipatory bail passed by the Hon'ble Division Bench of this Court and before the Hon'ble Apex Court. The Hon'ble Apex Court initially passed the order granting interim protection of arrest on condition that the petitioner was cooperating with the investigation officer. Such order was passed on 10th of February, 2020. However, on 13th of February, 2023, such Special Leave Petition was withdrawn.
Records of the case reflect that warrant of arrest is pending against the present petitioner. The petitioner will surrender on or before 20th of February, 2024, the next date so fixed before the ld. CMM, Calcutta.
In case, the petitioner surrenders before the ld. trial court, in that case, the ld. trial court will consider his bail
application in accordance with law after noticing the investigating officer of the case thereby verifying as to whether he has cooperated with the investigating officer or not.
In view of the process issued by the ld. trial court, at this stage, I am not inclined to interfere with the chargesheet. However, the petitioner would be at liberty to approach this court after receipt of the documents under section 207 of the cr.p.c.
With the aforesaid observations, CRR 3944 of 2023 is disposed of.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
