Madhu Rohidas @ Madhu Ruhi Das v. State Of West Bengal
20.01.2026
IN THE HIGH COURT AT CALCUTTA
Item No.ML50 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 Susanta Rejected C.R.M. (NDPS) 1320 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Shalimar GRPS Case No. 39 of 2024 dated 20.07.2024 under Sections 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 27 of the Drugs and Cosmetics Act, 1940.
And In Re : Madhu Rohidas alias Madhu Ruhi Das ... Petitioner.
Mr. Abhishek Chakraborty, ... For the Petitioner.
Ms. Shaila Afrin, Ms. Sana Naaz, ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case for alleged recovery of 840 bottles of Phensedyl and is in custody for one year six months.
The grievance of the petitioner is that hardly there has been any progress in the trial and only one witness out of proposed 18 witnesses have been examined till date. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the submissions of both the parties and direct the learned Trial Court to give priority for examination of the seizure list witnesses and the evidence of such witness be completed within a period of three months from date.
The petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses are complete. Accordingly the prayer for bail application of the petitioner, at this stage, is rejected.
The application for bail, being CRM (NDPS) 1320 of 2025, is, thus, dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
