The writ application has been preferred challenging an order dated 23.07.2025 passed in Appeal Case No. 152-157/25 under Section 54 of the West Bengal Land Reforms Act, 1955 passed by the Additional District Magistrate and District Land & Land Reforms Officer, South 24 Parganas at Alipore. 2.

It is submitted by the learned Counsel for the respondent that the said order is an appealable order which is admitted by the petitioner who submits that as the West Bengal Land Reforms and Tenancy Tribunal is not functioning the petitioner could not prefer an appeal.

The said contention of the petitioner is not substantiated as the West Bengal Land Reforms and Tenancy Tribunal is being presided over by regular officers.

Considering the same, the writ petition is disposed of with liberty granted to the petitioner to prefer an appeal within 30 days from the date of this order. Period of limitation is extended accordingly in the interest of justice.

With the above direction, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
