1. Affidavit of service filed in Court today is taken on record.

2. Instruction forwarded by the Executive Engineer, Tamluk Division, PHE Directorate is taken on record.

3. The petitioner alleges that the State respondents are installing submersible pump in plot no. 1262 of MouzaHarasankar Garkilla, DistrictPurba Medinipur, contrary to the provisions of law.

4. An objection was filed before the Assistant Engineer Public Health Engineering Directorate and before other State authorities but the same is alleged to be kept pending.

5. The Executive Engineer, Tamluk Public Health Engineering Directorate has forwarded instruction to the Court enclosing the record of rights in respect of plot no. 1262. It appears therefrom that, the said land is recorded in favour of the State. By virtue of inter departmental transfer, the land has been transferred in

favour of the Public Health Engineering Directorate. The Directorate has started pipe line work and is constructing a pump house which will be used for supplying drinking water to the villagers.

6. As it appears that, the petitioner has not been able to show any document before the Court relating to the ownership of the subject plot of land, accordingly, the prayer of the petitioner for consideration of the representation cannot be allowed.

7. The writ petition fails and is hereby dismissed.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
