Pursuant to the previous order, on behalf of the District Inspector of Schools (S.E.), Uttar Dinajpur, being respondent no.5, a communication dated December 3, 2024, addressed to the learned Advocate representing the State-respondents is filed before this Court wherefrom it appears that the petitioner made an application for transfer on November 14, 2022, which was after suspension of Utsasree portal on and from September 29, 2022.
It has been submitted on behalf of respondent no.5 that transfer application of the petitioner could not be processed since such application was made after suspension of portal with effect from September 29, 2022.
On perusal of the writ petition, it appears that this is not an application for transfer on medical
ground since applicant-teacher is suffering from serious ailment/terminal disease. Neither this is an application for transfer on other grounds as delineated under amended Rule 4(b) to 4(e) as contained in Government Notification dated September 8, 2021. At this stage, if Court directs the concerned respondent authorities to take decision on transfer application of the petitioner, which was made on the ground of distance between the present school of the petitioner and his place of residence, virtually that would be a direction upon the authorities to take decision on transfer application, which was made on offline mode. During suspension of portal, such prayer is not allowed since it will open floodgate.
Hence, the writ petition stands dismissed.
