The petitioner has prayed for expeditious disposal of NDPS Case No.334/2014 arising out of Raghunathganj Police Station Case No.1052 of 2014 dated 01.12.2014. Learned counsel for the petitioner submits that in connection with the instant case charge-sheet was framed on 25.01.2024 and the next schedule has been fixed on 03.05.2024.

It has also been submitted that the prosecution has relied on 10 witnesses and till date none of the witnesses has been examined.

Having regard to the fact that more than nine years have expired, the initiation of trial of the case should be expedited.

Accordingly, I direct the Special Court, Berhampore, Murshidabad to fix a schedule consisting of three dates and fix a schedule once in every 30 days, so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournment should be granted to the parties.

In case any witness is not available, communication be made to the superintendent of police of the concerned district for submitting a report regarding the availability of the witness concerned.

The office of the superintendent of police would submit a report on the next date regarding the availability of the witness or the reasons for which the witness is not available for being cited in support of the prosecution case. Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.

With the aforesaid observations, CRR 3946 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
