The petitioners are aggrieved by the fact that in spite of the private respondents being restrained from disturbing the peaceful possession of the present petitioners as directed by the learned Civil Judge (Jr. Div.), 1st Court, Paschim Medinipur, he is being heckled by the private respondents. To that effect, he informed the Officer-in-Charge, Sabang Police Station on 22.08.2024.

Learned advocate for the State submits a report which reflects that the police authorities on 24.08.2024 have drawn up proceedings under Section 126 of BNSS.

In view of the police authorities themselves are of the opinion that there is a possibility of breach of the peace and tranquility in the area, I

direct that the police authorities would keep a strict vigil so that no untoward incident happens because of the existing dispute between the petitioners and the private respondents.

The petitioners submit that their attempt for cultivation is being disrupted by the private respondents. If there are subsequent events which have taken place, the petitioners would inform the local police station. The local police station would ensure that the petitioners being undisturbed can proceed with their agricultural work at the subject land referred to in the writ petition.

With the aforesaid observations, the writ petition being WPA 24875 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
