This is a matter of shortfall of nearly four months in qualifying service. For such shortfall, as of now the petitioner is not entitled to get pensionary benefits. However, under the DCRB Rules, there is a provision where the Secretary of the School Education Department can take a decision as to this shortfall and in appropriate cases he can also remove the defect of shortfall upto six months.

Therefore, I direct the Principal Secretary of the School Education Department, Government of West Bengal to look into the matter and take a sympathetic view in the matter of the petitioner within a period of three months from the date of communication of this order.

With this observation and direction this writ application is disposed of.
