Learned counsel for the petitioners submits that the petitioners are in custody for one year nine months and till date none of the prosecution witnesses has been examined, although charge was framed on 06.09.2023 and the next schedule has been fixed on 05.03.2024.

Having considered the agony expressed by the petitioners, I am of the view that the same is justified. Accordingly, I direct the trial court to fix a schedule consisting of three dates and fix a schedule once in every 60 days, so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to the parties.

In case any witness is not available, communication be made to the superintendent of police of the concerned district for submitting a report regarding the availability of the witness concerned.

The office of the superintendent of police would submit a report on the next date regarding the availability

of the witness or the reasons for which the witness is not available for being cited in support of the prosecution case. Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.

With the aforesaid observations, CRR 3947 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
